Digital Gift Card Terms & Conditions

1. Purchase and Use

These Terms and Conditions (“Terms”) govern the purchase, use, and acceptance of HarperCollins Publishers (“HC”) digital gift cards (“Gift Cards”). By purchasing or using a Gift Card, you agree to accept these Terms, as well as our website’s Terms of Use and Privacy Notice. HC reserves the right to update or modify these Terms at any time without prior notice, with the current version posted on our website.

Gift Cards are redeemable only for eligible purchases of products and digital content on the HC websites specified on the card or accompanying materials. All Gift Card sales are final; Gift Cards are non-returnable and non-refundable (except where required by law). Gift Cards may not be used for any unauthorized purpose, including:

  • Cash Redemption: Gift Cards are not redeemable for cash or cash equivalent, except where required by law (see Section 5 State-Mandated Cash Redemptions below).
  • Purchasing Other Cards: Gift Cards cannot be used to purchase other gift cards or prepaid cards.
  • Credit or Third-Party Payments: Gift Cards cannot be applied as payment to any credit accounts or used on third-party e-commerce sites.

The risk of loss and title for the card passes to the purchaser or designated recipient upon electronic delivery. HC is not responsible for any Gift Card that is lost, stolen, destroyed, or used without your permission (see Section 3 below on Fraud and Unauthorized Use for details on protections).

HC Gift Cards are sold directly through our online store and delivered electronically (e.g., via email) to you or your chosen recipient. You may personalize an email gift message at the time of purchase. Delivery may be subject to technical delays or errors outside our control. Please ensure the recipient’s email address is entered correctly; HC is not liable for errors caused by incorrect recipient information or email delivery issues.

2. Expiration, Fees, and Balance Management

No Expiration or Fees: HC Gift Cards do not expire, and no service fees, inactivity fees, or other post-purchase fees apply to their use. You will never be charged any fees that diminish the balance of your Gift Card.

Balance Inquiries: You can check your Gift Card balance at any time on our website or by contacting HC Customer Service. The balance displayed is an estimate and may not immediately reflect very recent purchases or redemptions (it may take a short time for transactions to post to your Gift Card account).

Unclaimed Property: While HC Gift Cards themselves do not expire, unredeemed Gift Card balances may be subject to state unclaimed property (escheat) laws after prolonged periods of inactivity. Depending on the state, if a Gift Card remains unused for a certain number of years, HC may be required by law to report and remit the remaining balance to the state treasury as unclaimed property. (Many states exempt single-merchant gift cards from escheatment requirements, but if applicable, we will comply with all such laws.) To avoid any potential escheatment of your funds, we encourage you to use your Gift Card in a timely manner.

3. Fraud, Loss, and Unauthorized Use

Lost or Stolen Cards: Safeguard your Gift Card code like cash. HC is not responsible for any Gift Card that is lost, stolen, damaged, or used without authorization. Treat Gift Card codes as confidential; do not share your card number or redemption code with anyone you do not trust. If you believe your Gift Card has been lost or stolen, contact Customer Service promptly. Gift Cards will only be reissued or replaced (at HC’s sole discretion) if you provide valid proof of purchase and the card still has a verifiable remaining balance. Any replacement will be limited to the balance remaining at the time of replacement.

Fraud and Misuse: HC reserves the right to reject or deactivate any Gift Card, or to suspend or cancel any Gift Card or transaction, if we suspect fraud, unlawful activity, or any violation of these Terms. Prohibited activities that constitute misuse of Gift Cards include, but are not limited to:

  • Unauthorized Resale or Exchange: Selling a Gift Card (or its redemption code) or exchanging it for cash or other value, except as expressly permitted by law, is prohibited.
  • Tampering: Altering, duplicating, or falsifying Gift Card information or barcodes is fraudulent and forbidden.
  • Fraudulently Obtained Cards: Using Gift Cards obtained through theft, fraud, or deception (for example, using a stolen credit card to purchase a Gift Card) is prohibited.

Any violation of these restrictions may result in the Gift Card being voided (cancelled without reimbursement), and HC reserves the right to take legal action in such cases. We may also request an alternative form of payment if a Gift Card is suspected to be obtained or used fraudulently.

4. Promotional and Bonus Gift Cards

From time to time, HC may offer promotional, bonus, or loyalty Gift Cards (for example, a “free $10 Gift Card with purchase” promotion or store credit issued as customer service courtesy). Such promotional Gift Cards are typically provided to you at no direct cost and may be subject to additional terms or restrictions. Any special conditions will be clearly disclosed in the promotional materials or on the card. These conditions may include expiration dates, usage or redemption limits, minimum purchase requirements, or other limitations.

Except as modified by the specific promotion, promotional and bonus Gift Cards are otherwise treated the same as standard Gift Cards under these Terms. They cannot be redeemed for cash (except where required by law) and are subject to all fraud prevention and misuse provisions herein. Promotional cards are not reloadable and cannot be resold. Once a promotional Gift Card expires or its value is used, it will be deactivated and will not be replenished or replaced.

5. State-Mandated Cash Redemptions

Certain states require that merchants allow consumers to redeem low remaining balances on gift cards for cash. HC will comply with all state-mandated cash redemption laws. This means if you are in a U.S. state that grants consumers the right to cash out a Gift Card’s balance below a specified threshold, you may request a cash payment (or equivalent refund) of the remaining balance in accordance with applicable law.

How to Redeem for Cash (Where Applicable): If your Gift Card meets your state’s requirements for cash redemption, you may request the cash balance by contacting HC Customer Service. We may require proof of your residency or location (to confirm applicability of state law) and proof of ownership of the Gift Card. Eligible cash redemptions will be processed either by cash (if in person at a physical location) or via another reasonable method (such as check or electronic payment) within the time frame required by law. There is no fee for processing a required cash redemption. Please note that outside of these specific state-law circumstances, Gift Cards generally cannot be exchanged for cash or refunds.

6. Governing Law and Liability Limits

Governing Law: This agreement and any disputes or claims arising from your use of HC Gift Cards shall be governed by the laws of the State of Tennessee, USA, without regard to its conflict-of-law principles. By using the Gift Card, you agree that any legal action or proceeding (to the extent not subject to an arbitration agreement or otherwise resolved by alternative dispute resolution) will be brought in the appropriate state or federal courts located in Tennessee, and you consent to the jurisdiction of those courts. (Some jurisdictions do not allow certain choice-of-law or venue provisions, so this clause may not apply to the extent it conflicts with local consumer protection laws.)

Limitation of Liability: HC and its affiliates shall not be liable for any losses or damages resulting from: (a) lost, stolen, or unauthorized use of any Gift Card; (b) your inability to use a Gift Card due to technical issues, delays, or outages; or (c) errors (such as sending a digital Gift Card to the wrong email) that occur due to incorrect information provided by the purchaser. HC makes no warranties, express or implied, with respect to the Gift Cards or your balance, and disclaims any implied warranties to the fullest extent permitted by law. In any event, HC’s maximum liability for any claim related to a Gift Card is limited to the remaining balance on that Gift Card at the time the claim arose. HC will not be liable for any indirect, incidental, punitive, or consequential damages related to the use or misuse of Gift Cards. These limitations on liability are a fundamental part of these Terms and HC would not issue Gift Cards without such limitations.

No Illegal Use: You agree not to use Gift Cards in any manner that is misleading, deceptive, unfair, or otherwise harmful to HC or its customers. Any use of HC Gift Cards in violation of these Terms may result in voiding the Gift Card and other remedies.

Severability: If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be deemed severable from the Terms and will not affect the validity and enforceability of the remaining provisions.

Entire Agreement: These Gift Card Terms constitute the entire agreement between you and HC regarding the Gift Cards and supersede any prior understandings or agreements (whether oral or written) regarding gift cards. They do not alter the terms of any other agreements you may have with HC (such as website terms of use or product purchase terms), which continue to apply.
